            Case of the complainant K.J. Mathew in brief is that the opposite party failed to refund his deposit Rs.2000/-that he paid for installing the cable connection even after he ceased to be a customer after paying all the dues.

2.         Notice to opposite party sent by registered post.  But opposite party refused to accept the notice since the name of the proprietor shown was not correct.  We treat it as sufficient notice since the opposite party is well aware that it is a notice issued from the Forum.  Instead of ignoring the slight change in the spelling of his name opposite party could have accepted the notice.  Such old tactics of evading notice cannot be tolerated. Hence the notice is treated as served and the opposite party is set exparte.

3.            Complainant examined as PW1.  He deposed that he had paid the monthly subscription to opposite party till the cessation of the connection.  After termination of connection he demanded the advance deposit but opposite party refused to repay it.

            The case of the complainant is proved.  The non-refund of security deposit/advance after termination of cable connection is a deficiency in service.  Opposite party is liable to refund the said amount.  Therefore the Proprietor of Metro Cable Vision by whatever name he is called is directed to refund Rs.2000/- to the complainant that he received at the time for providing connection from the complainant with a cost of Rs.1000/-.  Time for compliance is limited to 30 days from the date of receipt of copy of order.  Failing which the said amount of Rs.2000/- will carry interest @ 12% from the date of complaint till payment.
