ORDER

By Smt. Padmini Sudheesh, President: Petitioner’s case is as follows. 1.The respondent is conducting partnership business of providing manpower services. Petitioner and his wife are aged couple and approached the respondent to get the service of a servant for doing household work for one month. On 17.12.07 Rs.4000/- paid to the respondent and Rs.3000/- towards salary and Rs.1000/- towards registration fee. At the time of making the payment the respondent had assured an uninterrupted service. On 17.12.07 itself the respondent had sent a lady. On 24.12.07 the servant had informed him that she will go home for Christmas on 26.12.07 and the servant had not returned. The matter is informed to the respondent and assured that another servant would be provided within two days. Even after two weeks time the respondent had failed to provide the servant. He had hired the service of the respondent, since his grand children are coming for Christmas holidays. Due to the non-availability of the servant he had to suffer a lot. Hence this complaint. 2. The notice from the Forum is returned as unclaimed. On 19.3.08 the respondent is declared as exparte. 3. To prove the case of the petitioner he has filed affidavit and two documents. The documents are marked as Ext. P1 and P2. 4. Heard the Counsel. 5. According to the petitioner, he is entitled to get back Rs.4000/- with interest and compensation and costs. There is no counter evidence to the evidence of the petitioner. 6. So the petition is allowed and the respondent is directed to return the petitioner Rs.4000/- (Rupees four thousand only) with interest at the rate of 12% per annum from 24.12.07 till realization and cost of Rs.500/- (Rupees five hundred only). Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 12th day of May 2008.
