ORDER

It is stated that in response to order dated 05.10.2018, possession of the unit, in question, was handed over to the decree holders on his depositing the balance amount.

                It is stated by Sh. Parveen Gupta, Advocate, Counsel for the decree holders that there are some small defects in the unit.

                Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors assures that if any defects are there, those will be removed within next three weeks. It is further stated that in Appeal bearing No.1267 of 2018 filed by the judgment debtors against the judgment under execution, conditional stay was granted and in response to order passed by Hon’ble National Consumer Disputes Redressal Commission, New Delhi on 03.10.2018, the judgment debtors have deposited an amount of Rs.8,05,268/- with this Commission on 02.11.2018 by moving Miscellaneous Application No.620 of 2018.

                It is stated by Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors that some amount is still payable by the decree holders to the judgment debtors. Be that as it may, the said amount can be adjusted by the judgment debtors against the amount payable towards penalty for delay and on the balance amount, no penal interest shall be levied. 

                The execution application stands disposed of accordingly, with liberty to the decree holders to file it again as and when need to arises in final decision so passed in the aforesaid appeal or the stay granted is vacated/varied.

                Certified copy of the order be sent to the parties free of charge.
