     None for the appellant is present.  Adv. S KTambde as well as Adv.Mr Kale for the appellant are also absent.  Adv.Mr S Thame for the respondent is present and submitted that this appeal has already become in fructuous as the original execution proceeding before the District Consumer Forum, Nagpur has been disposed of. But he has not filed the record to that effect.  However, since the appellant as well as its counsel are absent since the month of Oct.2010, we have no hesitation to accept the submission of Mr Thamke, Advocate for the respondent.  

     Since appellant as well as its counsel are absent, this appeal stands dismissed for default.

     No order as to cost..
