Smt. A. Nanda, Member (W): - The brief facts of the consumer complaint are that, the complainant purchased one bedsheet worth of Rs.1,195/- only with other articles and paid Rs.2240/- in total to the O.P. The sales person prior to purchase of bedsheet told that there was no defect in the bedsheet and it was properly packed. The complainant taken the said bed sheet to his home and while opening he found that the bed sheet was parcially damaged so it cannot be used. The complainant came to the shop of O.P and requested to replace the defective bed sheet or return the consideration amount but the O.P remain silent, hence this case.
Being noticed through this Forum, the O.P. is neither appeared before this Forum nor submit his written statement, hence the O.P.is set ex-parte.
Heard from the complainant who has filed the cash voucher along with a photograph of defected bed sheet. The O.P. remained silent which reveals that the O.P has nothing to say in this case. The complainant has purchased the said bed sheet amounting Rs.1,195/- only along with two articles and paid Rs.2240/- only in total on dtd.05.03.2017 to the O.P. The O.P has given a damaged bed sheet which was packed and on the assurance of his sales person the complainant has taken to his home by keeping belief. On request the O.P remained silent so also in the case which reveals that the O.P has adopted unfair trade practice towards the complainant.
Hence the complaint petition is hereby allowed by directing the O.P to replace the defected bed sheet with a defect free bed sheet of the same price or refund Rs.1195/- ( Rupees one thousand one hundred and ninety five) only towards the price of bed sheet to the complainant and pay s sum of Rs.500/- ( Rupees five hundred) only to the complainant towards harassment, mental agony including litigation costs within one month from the date of receipt of this order.
Accordingly the case is disposed of.
Order pronounced in the open court today on this the 19th day of July 2017, copy of this order shall be communicated to the parties as per Rule.
