26-08-2014: Case called out repeatedly. None is present on behalf of the applicant – appellant. Learned counsel for the respondent is present.

On 280.01.2014, this Commission passed an order that in case the applicant – appellant does not  appear on the next date fixed, then the matter shall be decided in accordance with law.

This appeal was received by the office of the Commission through post on 22.08.2012. The appeal was preferred with a delay of 22 days. Thereafter several dates were fixed, but the applicant – appellant did not appear on any date fixed.

As neither the applicant – appellant, nor any counsel on his behalf has appeared to press the delay condonation application or the appeal itself , we do not have any other option except to dismiss the delay condonation application in default of the applicant – appellant.

Accordingly, the delay condonation application is dismissed in default of the applicant – appellant. Consequently, the appeal also stands dismissed.
