Present:- Mr. Sunil Narang, counsel for the revisionists.
Present revision petition has been preferred against order dated 20.11.2023 passed by District Consumer Commission-Panchkula, vide which evidence of opposite parties No.1 & 2 has been closed. Learned counsel for revisionists has pointed out that case is now adjourned to 10.04.2024 before learned District Consumer Commission-Panchkula for addressing arguments. In this revision petition, learned counsel has urged that: only two effective opportunities be granted to revisionists-opposite parties No.1 & 2 to conclude their entire evidence and for that purpose; some cost can be imposed upon revisionists which would compensate complainant, in any case. He also urged that for this relief; notice of this revision petition to complainant is not required to be issued, to avoid unnecessary expenditure and also for saving time.
Keeping in view above contentions of hearing learned counsel for revisionists; this Commission is of firm opinion that: it appropriate to decide this revision petition at this motion stage itself, without issuing notice to complainant in order to avoid necessary expenditure and also to save precious time. It is settled legal adage that every litigant has an indefensible right to put forward his/her/its case, effectively and in process of justice dispensation; all effective parties to the lis must be heard. This Commission views that, no prejudice in the rights of the complainant would be caused, in case, revisionists-opposite parties No.1 & 2 are granted two effective opportunities to lead and conclude their entire evidence. Consequently, in interest of justice, revisionists-opposite parties No.1 & 2 are hereby granted two effective opportunities to conclude their evidence. On the date already fixed before learned District Consumer Commission-Panchkula, i.e. on 10.04.2024, the revisionists-opposite parties No. 1 & 2 would bring their evidence, and try to conclude the same. In case, evidence of revisionists-opposite parties No. 1 & 2 is not concluded on 10.04.2024, then learned Consumer Commission would grant one more short adjournment for that purpose. In terms of above; this revision petition is allowed and impugned order dated 20.11.2023 passed by learned District Consumer Commission-Panchkula is hereby set aside. Complainant would be compensated with cost amount of Rs.5,000/- to be paid to him by revisionists-opposite parties No. 1 & 2, on 10.04.2024.
Accordingly, R.P. No.16 of 2024 stands disposed off being allowed. File be consigned to the record room.
