Order No.03, Dated:22.04.2015

Today is fixed for ER of W/A.  The Dhr. files hazira.  The Jdr. Amitava Som personally appears before this Forum.  He is taken into custody.  The Jdr. Amitava Som files a petition along with a bankers cheque for Rs.29,182/- being No.000444 dated 22.4.2015 drawn on HDFC Bank to comply the award passed against him in the final order under execution.  Let the bankers’ cheque as mentioned be kept in the safe custody of this Forum for handing over the same to the Dhr.

            The petition filed by the Jdr. and the petition filed by the Dhr. are taken up for hearing.  Heard both the sides.  During the course of hearing both the parties have admitted that out of this Forum they have made a discussion and calculation.  The Dhr. by filing a petition has submitted before this Forum that on calculation the awarded amount will be Rs.29,182/- and Jdr. has paid the same by issuing the bankers’ cheque as mentioned above and as such he is not willing to proceed with this case further and has prayed to dispose of the case on full satisfaction.  Considered.  We are satisfied with the submission and contents of the petitions filed by the Jdr. and the Dhr. and we hold that the case should be disposed of on full satisfaction.

            Hence, it is

ORDERED

 that the Execution Case No.22/2015 is disposed of on full satisfaction.

            Release the Jdr. at once.

            Recall the W/A issued against the Jdr. vide Order No.2 Dated 23.3.2015 at once.  Let the copy of this order be supplied to the parties free of cost.
