This case record is taken up for consideration in the matter of passing order in respect of the petition filed by OP stating inter alia that the complaint case no.50/2023 is not maintainable in the eye of law and so the said complaint case is required to be dismissed.

This matter has been contested by OP side.

Heard ld. advocate of both sides.  Considered submission.

Perused the MA application.

On close examination of the MA application it appears that the “Cause Title” of the said MA application is outrightly defective as because this MA case has been filed by Sri Amit Koley who is the OP of above noted complaint case and said Amit Koley is to be described as petitioner of the MA application and this MA case has been filed against Tarakeshwar Singh who is the complainant of above noted complaint case and said Tarakeshwar Singh should be described as OP of this MA case.  But fact remains that this procedure has not been followed.

Thus it is crystal clear that the MA application being no.57/2023 has been filed in defective condition and so this MA case no.57/2023 is dismissed on contest. 

No order is passed as to cost.

In the light of the observation made above this MA case is disposed of.
