ORDER

Complainant physically present. OP no-1 represented. OP no-2 absent. Present consumer complaint relates to deficiency in service from the part of the OP’s as alleged.

Case of the complainant in nutshell is that the mobile set purchased from the OP no-1 on 24.01.2023 became defective within the warranty period but the services were not provided by the OP no-2 any other service centre, Patna.

From a bare perusal of the complainant itself it appears that the alleged mobile set belong to Samsung India Limited neither of the OP no-1 nor of OP no-2 manufacturer of the alleged mobile set who was under a obligation to either the replace the defective mobile set or to compensate the loss has not been made party as the complaint petition suffered from the defect of parties, hence the present complaint is dismissed as not maintainable.

However, it is observed that the complainant shall be liberty to file the fresh complaint against the necessary and proper parties subject to the period of limitation as given under section 69 of the Consumer Protection Act, 2019
