1. Amit Financial Services, near Tehsil Complex, Kalka, Tehsil Kalka, District Panchkula through its authorized signatory Amit Kumar.

2. Aadhar Housing Finance Ltd., S.S. N. Towers, 2^nd Floor, SCO No. 23, Ambala-Zirakpur Road, near Corporation Bank, Zirakpur, Tehsil Dera Bassi, District SAS Nagar Mohali (Punjab).

3. Pramerica Life Insurance Limited(Erstwhile DHFL Pramerica Life Insurance Co. Ltd.), 4^th Floor, Building No. 9, Tower B, Cyber City, DLF City Phase III, Gurugram-122002, through its authorized signatory.

4. DHFL General Insurance Limited, 402, 403 & 404, A & B Wing, 4^th Floor, Fulcrum, Sahar Road, Next to Hyatt Regency, Andheri(East), Mumbai (Maharashtra)-400099 through its authorized signatory.

COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Present:-      Sh. Ashok Kumar, Advocate, for the Complainant.

                   None for OP No. 1.

                   Sh. Deepanshu Soni, Authorised Representative of OP No. 2

                   None for the OP No. 3.

                   Sh. Ankur Gupta, Advocate, for OP No. 4.

                  

                   Today the case is fixed for amicable settlement. At this stage, Sh. Deepanshu Soni, Authorised Representative of OP No. 2, by making a separate statement, has stated that the documents/property papers have been returned to the Complainant in original under endorsement, and that now, the loan account of the complaint has been settled and nothing remains due against the loan account of the complainant. He has further stated the original blank cheques have been destroyed; hence only the property papers in original have been returned.

                   On the other hand, Ld. Counsel on behalf of the Complainant, by making a separate statement, has stated that the Complainant has received the property papers from the OP No. 2 and grievances of the Complainant have been redressed by the OP No. 2. Ld. Counsel has further stated that some blank signed cheques have not been returned to the Complainant; however, the OP No. 2 has assured that the same have been destroyed and that on the basis of such assurance, the Complainant is no more interested to pursue the present complaint; hence, I withdraw the present complaint on behalf of Complainant, being fully satisfied.

                    Heard. In view of the statements made by the Ld. Counsel for the Complainant as well as Sh. Deepanshu Soni, Authorised Representative of OP No. 2, the present complaint is hereby ordered to be dismissed as withdrawn, being fully satisfied. It is made clear that both the parties shall be bound by their respective statements. In case, the OP No. 2 fails to comply with the statement made by the Sh. Deepanshu Soni, Authorised Representative on its behalf, in that event, the Complainant shall be entitled to invoke proceedings under section 71/72 of the CP Act, 2019.

                   A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
