Heard learned counsel for the petitioner. Appeal was dismissed by the State Commission vide order dated 30.5.2012 on account of absence of the petitioner as well as his counsel. Learned counsel for the petitioner submitted that this was the first date before the State Commission. He also moved an application before the State Commission on the very day i.e. 30.5.2012 in which it was stated -2- that the petitioner counsel could not reach Court upto 12.00 on account of defect in the vehicle. Thus, it becomes clear that counsel for the petitioner reached before State Commission after dismissal of the appeal on the very day. Consequently, revision petition is accepted and order of the learned State Commission passed in F.A. No. 204/2012 (Standard Chartered Bank vs. Amit Dhamija) is set aside and matter is remanded back to the State Commission to dispose it of on merits, subject to deposit of Rs.5,000/- as cost to be deposited by the petitioner in the Legal Aid Account of the State Commission. Petitioner is directed to appear before the State Commission on 21.9.2012. Copy of the order may be given dasti.
