ORDER

1. The appellant/complainant has preferred this appeal being aggrieved by the Order dt.08.01.2015 passed in CC.No.294/2014 on the file of 1st Additional District Consumer Disputes Redressal Commission, Bangalore.
2. The Appellant not present since long time. The respondent submitted his arguments and submits that the complainant/appellant filed a complaint before the District Commission alleging deficiency in service in deduction annual maintenance charges towards credit card and prayed for refund of the entire bill amount for which the District Commission dismissed the complaint. Aggrieved by the said Order, the appellant/complainant before this Commission, but, not submitted any arguments in his favour. The respondent further submits that the complainant had applied for American Express Platinum Credit Card as he was travelling regularly to other places and agreed to pay Rs.50,000/- lifetime membership of Rs.10,000/- annual charges and they have provided an American Express Platinum Charge Card bearing No.3769 160300 73004 on 16.06.2009 to the complainant with lot of benefits and discounts whenever he preferred. Subsequently after obtaining the card, he utilized and availed certain discounts from the company after that they have issued a bill for payment of the annual amount, but, not satisfied with the bill, the complainant approached the District Commission alleging deficiency in service wherein the District Commission has rightly dismissed the complaint, hence, respondent prayed to dismiss the appeal.

On going through the memorandum of appeal, certified copy of the Order passed by the District Commission, we noticed that it is an admitted fact that the appellant/ complainant has obtained American Express Platinum Charge Card from the respondent/Opposite Party which a different from other credit cards. The complainant also agreed to the terms and conditions of the said charge card and obtained. He also agreed to pay the annual charges towards the card. When he agreed, the appellant/ complainant cannot escape from the liability. We found there are no any merits in the appeal and the District Commission has rightly appreciated the facts and dismissed the complaint. Hence, the following;
ORDER
The appeal is dismissed.
