Today the case is fixed for consideration on the point of admissibility. None has put into appearance on behalf of the complainant.
Brief facts of the complaint are that complainant had purchased chlorantraniliprole Technical for consideration of Rs.1,50,000/- from OP and OP sent the same to the complainant on 01.02.2023. After taking the goods, the complainant made test from Lab but same was found 0% and when the complainant told about this then OP gave assurance to complainant that OP will pick up the said goods and will return the amount of Rs.1,50,000/- but till today, neither the OP picked the same nor returned the amount despite repeated requests. Hence, the present complaint.
A careful perusal of the file reveals that the alongwith the complaint, neither the complainant has placed on file photographs of chlorantraniliprole Technical nor has placed on file copy of Lab report on the basis of which he has filed the present complaint. Hence, it reveals that the present complaint has been filed only to waste the precious time of this Commission.
Moreover, today none has put in appearance on behalf of complainant. It is already 03:30 PM. Further wait is not justified. It appears that complainant is no more interested to pursue his case. There is no justification to adjourn the case further for the same purpose as statutory period of admissibility of complaint is going to be expired prescribed under Consumer Protection Act, 2019.
Hence, in view the above facts the present complaint is hereby dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action after placing on record the requisite documents like lab report etc, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
