 The case of the complainant is that,  
 
Complainant purchased  a Mobile Phone, Branded Redmi-35 from online selling agency, the Amazon, the first opposite party, through the seller of Mobile, the second opposite party, by paying an amount of Rs.6999/- on 08/02/17.  On a rethinking he intended to purchase a phone of the same company branded name Redmi 35 – Prime, having much more facility than the above one, he returned the phone to the second opposite party on 18/02/17 through post office, Painav, the complainant returned the mobile to the second opposite party, and  he got information for the receipt of the same  from the second opposite party, and he  waited for the refund.  Unfortunately the opposite parties not refunded the amount to the complainant, and the complainant contacted the second opposite party for the same, and the complainant send all the transaction records to the second opposite party as they demanded.  Thereafter also they were not turned up to refund the amount to the complainant and hence he approached this Forum alleging unfair trade practice against the opposite parties and for getting back the amount that the opposite parties   received from him  and other consequential reliefs.

Even though the notice from this Forum was accepted by the opposite parties, they were not turned up to contest the matter even to file a reply version.  Hence after giving sufficient time  to appear of the opposite parties,  Forum declared them ex-parte and ex-parte evidence taken.
 
For substantiating his pleading complainant produced final  detail of order issued by the opposite parties, Amazon and the consignment details.  These two documents  are considering as a part of evidence and marked as Ext.P1 and Ext.P2 respectively.  By perusing these documents Forum convinced that the allegation levelled against the opposite parties in the complaint are true and un challenged.  Hence  on the basis of the above, the Forum allowed the complaint and directed the opposite parties one and two to pay an amount of Rs. 6999/- to the complainant and also directed  them to pay an amount of Rs.1000/- as litigation cost, jointly within   30 days of the receipt of a copy of this order,  failing which amount of the first head shall  carry 12% interest per annum from the date of default  till the realization.
