CC No.437 of 2023.

Shanky vs. Amazon.

 

Present:       None for complainant.

 

                   This case has been called several times since morning, but the complainant failed to appear before this Commission, either in person or through any Advocate, up to 3.05PM.  On the last date of hearing i.e. 8.12.2023, same was the position and in terms of order dated 24.11.2023, which was passed in presence of the counsel for the complainant, the complainant has not done the compliance of it by producing on record proof of video in the form of CD and Pen-drive as pleaded by the complainant in para No.2 of the complaint. Non-production of video alleged by the complainant, despite availing opportunity from this Commission, amounts to patent defect in the evidence and once the complainant is not obeying the direction of this Commission, it seems he does not want to prosecute the present compliant.

                Hence, the complaint is rejected, due to non-compliance of order dated 24.11.2023, amounting to patent defect in the evidence, however, the complainant shall be at liberty to file a fresh complaint, after removing the patent defect as observed here-in-before and in the fresh complaint, the complainant will disclose the particular of this compliant and its fate.  Certified copy of this order be supplied to the complainant free of costs.  The complainant is left to bear their own cost of litigation. Original document Ex.C.2 is hereby ordered to be returned to the complainant or his counsel against proper receipt. File be consigned to the records.
