Appellant through Ld. Advocate and Respondent in person are present.  This appeal has been filed out of time by about 14 days.  The impugned judgement has been passed on 29.10.2010.  It has been stated in the above application that the Appellant came to know of the said order order on 10.11.2010 as the impugned order was passed ex-parte.  Even after knowledge of the said order dated 10.11.2010 the appeal has been filed after expiry of more than three months for which the explanation has been given as being the procedural delay in taking approval from the different official authorities.  Upon reading of the aforesaid explanation we are not satisfied that the Appellant – Postal authorities acted with due diligence.  Accordingly we are not inclined to condone the delay on any sufficient reason.  The petition for condonation of delay is accordingly dismissed.  The appeal be dismissed as being barred by limitation.
