            This Revision Petition has been filed against order dated 29.08.2016 passed by District Consumer Disputes Redressal Forum-I, U.T., Chandigarh (in short ‘the Forum’), in Consumer Complaint No.479 of 2016, vide which, on account of non-appearance on the date fixed, exparte proceedings were ordered to be taken up against the Revision Petitioner. Further prayer is to set aside the order dated 28.09.2016 dismissing an application filed by the Revision Petitioner to recall the order dated 29.08.2016.

2.         Let notice of the revision petition be sent to the respondent/complainant.

3.         Sh. Amarjit Singh, respondent/complainant is present before the District Forum and on our asking, he accepts notice of this revision petition. Copies of the revision petition and other documents annexed therewith have been supplied to him.

4.         At the time of hearing, Sh. Amarjit Singh, respondent/complainant very graciously states that let the orders be set aside and opportunity be given to the Revision Petitioner to contest the case on merits.

5.         Counsel for the Revision Petitioner states that written statement and evidence will be filed within 10 days from today.

6.         In view of above, the Revision Petition is accepted. Orders under challenge are set aside.

7.         The parties/their Counsel are directed to put in appearance before the Forum today itself.

8.         It is made clear that if reply and evidence are not filed, as undertaken, by the Revision Petitioner, this Revision Petition shall be deemed to have been dismissed and orders under challenge shall be deemed to have been confirmed.

9.         It is expected that the Forum shall decide the matter within one month expeditiously from the date of filing of reply and evidence.

10.        Order passed is subject to payment of Rs.3,000/- as cost. The said amount shall be paid by the Revision Petitioner to the respondent/complainant on the next date of hearing before the Forum.

11.        Certified copies of this order be sent to the parties, free of charge.

12.        Complete record alongwith a certified copy of this order be sent to the Forum, immediately, so as to reach there before the date fixed.

13.        File be consigned to the Record Room after completion.
