ORDER

                    It is stated by Counsel for the appellants/Opposite Parties that as the cancellation was done beyond the period of 10 days, in law, no amount is payable to the respondent/complainant. It was so said by making reference to the terms and conditions of the Policy and Membership Rules.   On our persuasion,  he states that as a goodwill gesture, the appellants will refund an amount of Rs.35,564/- plus Rs.2000/- towards compensation, to settle all the claims raised by the respondent/complainant.

                   Sh.Amarjit Singh, respondent/complainant is present in person. He accepts the proposal made by Counsel for the appellants.

                   It is stated by Counsel for the appellants that at the time when appeal was filed, the appellants had deposited an amount of Rs.22,782/-. Let  that amount be refunded in favour of the respondent/complainant (Amarjit Singh).

                   We order accordingly.

                   Secretary of this Commission is directed to issue cheque/demand draft in the name of the respondent/complainant (Amarjit Singh) for the said amount of Rs.22,782/- within 7 days from today.

                   It is stated by Counsel for the appellants that the balance amount will be paid to the respondent/complainant within four weeks from today through cheque or draft. We make it very clear that the order passed will not be a precedent in future. The grounds which are taken by the appellants, regarding the issue of claim, in question, are still available to the appellants/Opposite Parties to be taken up in any litigation in future.

                   In view of above, this appeal stands disposed of.

                   Certified copies of this order be sent to the parties, free of charge.
