BY THE STATE COMMISSION

 

This appeal has been filed against the judgment of learned DCF Sriganganagar dated 30.1.2015 by which the complaint was allowed.

 

The complainant had filed a complaint alleging that the opposite party had charged Rs.4000/- from him for issuing the TC of his daughter. The learned DCF on the basis of affidavits of two persons believed the complainant and allowed the complaint.

 

On going through the facts of the case we find that this cannot be a consumer dispute as the demand of Rs.4000/- was allegedly made illegally for issuing the TC. It is not a case where any services were obtained on payment and there was any deficiency of service. It was the duty of the school to issue the TC and if it was issued after accepting Rs.4000/- illegally by the Principal, it cannot be a consumer dispute and the remedy lies else where.

 

The complainant has not appeared before us in this appeal. We have heard the learned counsel for the appellant and

on the observations made above the judgment of the learned DCF is set aside and the appeal is allowed.
