1.      Amardeep Motors Ltd. Registered Office, 25/9, Industrial Area, Phase-11, Chandigarh.

2.      The Premier Automobiles Ltd., LBS Marg, Kurla, Mumbai-400070, through its General Manager

-          Opposite Parties

 

Present:           Sh. Ramesh Kumar Bamal, Adv. for complainant.

                        Ms. Anita Sharma, Adv. for OP-2.

 

Dated, the 15th day of October, 2010.

                                                            ORDER

 

                            This case has been taken up today in the Lok Adalat. The Counsel for the parties appeared and made their statements which is reproduced as under:-

“Statement of Sh.Ramesh Kumar Bamal, Adv. for complainant

 

The matter has been settled between the parties for a sum of Rs.5,25,000/- in full and final settlement of the claim. Today, I have received a sum of Rs.4,95,567/-  by way of draft no. 131038 dated 6.10.2010  drawn on State Bank of India, Mumbai, payable at par, in  name of the complainant from Mrs.Anita Sharma, Advocate for OP No.2, towards full & final settlement. This amount is accepted subject to TDS certificate of Rs.29,433/- The TDS certificate shall be sent by the OP to the complainant directly as per rule.  Hence, I withdraw the present execution application as satisfied.

I have gone thorugh the above statement and accept it as correct”.

 

2.                     In view of the above statements, the execution stands dismissed as withdrawn. However, the parties would remain bound by their statements.

3.                     The certificate issued to the Collector concerned under Section 25 of the CP Act is hereby cancelled and be called back.

4.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
