1.         Nobody appears for the appellant.

2.        This appeal has been filed against  the order dated 12.08.2014 passed in Complaint case no. 24/2012 by Learned District Consumer Forum, Palamu dismissing the Complaint case interalia on the ground that the Complaint was not maintainable against Amar Nath Singh Range Officer in individual capacity nor official capacity.

3.        The case of the complainant was that he supplied certain articles to the Opposite Party/respondent on 20.11.2011 worth Rs. 2,20,500/-, 30,000/- and 6,000/- respectively. He also paid the truck fare for sending the articles to opposite party. But when he demanded payment, opposite party refused and therefore the complaint was filed claiming value of the articles and compensation.

4.        The learned lower forum went into to the merits unnecessarily in as much as this complaint case itself was not maintainable. On the face of the Complaint, the Complainant was not a consumer. He did not buy any article or hired/availed any service from the opposite party/ respondent.

5.        In our opinion this Complaint Case and the appeal are absolutely misconceived. However, the appellant may file a suit if it is maintainable.

With this observation this appeal is dismissed.
