Heard the learned counsel for the petitioners. The petition has not been served on the O.P. It appears that notice issued to the OP returned with postal remark “addressee long absent”. Therefore, we think it just and proper to dispose of the revision petition at the stage of admission.

2.        It appears from the office note that  there is delay of 155 days in filing the revision petition. The delay has not been properly explained. Hence, the limitation petition is rejected.

3.        Consequently, the revision petition stands dismissed. Since the complaint case  is pendingbefore the learned District Commission, it should be disposed of within the statutory period.

4.        We hereby direct the learned District Commission, Sundargarh – II, Rourkela to proceed with the complaint petition and dispose of the matter within 45 days  from the date of receipt of this  order. The petitioner is directed to appear before the learned District Commission on 24.04.2023. It is made clear that all the issues raised in the complaint petition should be dealt with.

5.        Accordingly, the revision petition is disposed of.

            DFR be sent back forthwith.
