ORDER

1. Briefly stated, case of the complainant is that complainant has purchased Split AC from OPs along with stabilizer vide invoice / Bill No.RE850 dt.20/6/2017 for Rs.33500/-. The cooling was very less. When complainant got checked the AC from the service centre, it was found that there is a leakage of gas from AC. The defect had been detected within the warranty period. Complainant sent a legal notice dt.30/8/2018 to the OPs, but the OPs have not paid any heed to it. Hence this complaint.
2. Upon notice OPs No.2 & 3 appeared through counsel has denied all the allegations as alleged in the complaint.

Ld. counsel for the complainant has tendered in evidence Ex.CA affidavit of the complainant along with documents Ex.C-1 copy of receipt dt.20/6/2017, Ex.C-2 copy of retail invoice, Ex.C-3 copy of legal notice, Ex.C-4 postal receipt, Ex.C-5 copy of legal notice to OP No.2, Ex.C-6 postal receipt, Ex.C-7 copy of legal notice to OP No.3, Ex.C-8 postal receipt and closed the evidence.
4. Ld. Counsel for OPs No.2 & 3 has tendered Ex.OPA affidavit of Sh. Roopesh Jain, Auth. Representative of M/s Jhonson Controls- Hitachi Air Conditioning India Ltd. and close the evidence of OPs No.2 & 3.

Accordingly we direct the OPs to replace the compressor of the Air condition and repair the air conditioner to the satisfaction of the complainant, if the complainant is not satisfied from the work of the OPs, then he can again approach this forum. As the defect was detected within the warranty period. OPs are further directed to comply the order within a period of 30 days from the date of receipt of the certified copy of this order. Certified copy of this order be sent to the parties free of costs under the rules. Thereafter file be indexed and consigned to the Record Room.
