Gurdeep Singh Vs. Amar Agriculture

 

Present:       Sh. M.S. Kler, Adv. for the complainant.             

                    Sh. Naresh Khurana, Adv. for the respondent.

 

              Written statement not filed by the respondent. Parties have entered into promise and counsel for the parties suffered joint statement, according to which, the respondent has agreed to replace the defective machine, with new machine and complainant will contact to the respondent party alongwith old machine.

                   In view of the statement of the counsel for the parties, without making any adverse comment, on the act and conduct of any of the parties, as matter amicably settled, the complaint is partly, accepted against the respondent. The complainant will returned the Chaff Cutter, subject matter of the invoice Ex.C1, to the respondent, at his own cost, within the period of 15 days from today and thereafter, respondent will replace the old Chaff Cutter, subject matter of the invoice Ex.C1, without charging any extra amount, from the complainant party, within the period of one week from the date, when the complainant party returned the old Chaff Cutter and in case, of replacement of old Chaff Cutter with new one, complainant, again, faces any problem, then, complainant shall be at liberty to file a fresh complaint against the respondent and in a fresh complaint, complainant will disclose the particulars of the present complaint and its fate. Due to peculiarities of the facts, parties are left to bear, their own cost of litigation. Copy of this order, be supplied, to the parties, free of cost. File be consigned to the records.
