As per office report, notice could not be issued to respondents No.2 & 3, as amount in terms of the order dated 09.01.2019 passed by this Commission, has not been deposited.

After arguing for some-time, when this Commission was not inclined to interfere in the order passed, at this stage, Counsel for the applicant/appellant wishes to withdraw this appeal. He further states that the amount lying deposited with this Commission alongwith interest, if any, accrued thereon be transferred to District Consumer Disputes Redressal Forum-II, UT, Chandigarh to make payment to the complainant(s) to discharge the liability imposed.

In terms of the prayer made, this appeal is dismissed as withdrawn. Therefore, the application for condonation of delay stands infructuous.

Secretary of this Commission is directed to transfer the said amount, which was lying deposited with this Commission at the time of filing this appeal, to District Consumer Disputes Redressal Forum-II, UT, Chandigarh within seven working days from today.
