COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Ms. Jyoti Rani, Advocate, Counsel for OP No. 4.
File taken up on an application moved by the Complainant seeking permission to withdraw the present case.
Ld. Counsel on the instructions of OP No. 4 i.e. Samsung India Electronics Pvt. Ltd., by making a separate statement, states that the OP No.4 through its authorized service centre is ready to repair the product in question i.e. LED TV, free of costs, within 40 days from today, as per satisfaction of both the parties.
On the other hand, Ld. Counsel for the Complainant, by making a separate statement, states that he has gone through the statement made by the Ld. Counsel for the OP No. 4 and agrees with the same. He further states that as per settlement made between the parties, the Complainant will produce the product in question i.e. LED TV before the authorized service centre of OP No. 4 for its repair, free of costs, within 20 days from today, and thus, he withdraws the present complaint on behalf of Complainant.
Heard. In view of the statements made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective statements. In case, the OP No. 4 fails to comply with the statement made by the Ld. Counsel on its behalf, in that event, the Complainant shall be entitled to initiate proceedings under section 71/72 of the CP Act, 2019.
A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
