1. Gurmail Kaur complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that she obtained a policy bearing number 299504 dated 31.01.2014 from the OPs for deposit of Rs.36000/- in 36 monthly installments and OPs had to return Rs.47664/- after three years. On maturity the complainant submitted the required documents and requested the Op no.2 to release the maturity amount but the OP no.2 put off the matter on one pretext or the other. The OPs failed to pay the maturity amount till today. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-
i) OPs be directed to make/release the maturity amount of Rs.47664/- along with all other benefits and interest @18% per annum from the date of maturity till payment,
ii) OPs be directed to pay to the complainant a sum of Rs.50000/- as compensation on account of mental agony, harassment and litigation expenses.
2. Despite service the OPs did not appear and as such the OPs were proceeded exparte.
3. The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.
4. From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the parties, we find that the complainant obtained a policy bearing number 299504 dated 31.01.2014 from the OPs for deposit of Rs.36000/- in 36 monthly installments and OPs had to pay Rs.47664/- after three years. On maturity the complainant submitted the required documents and requested the Op no.2 to release the maturity amount.
5. The complainant has also produced on record receipt/slip regarding receipt of documents with OPs on 30.06.2017 which is Ex.C-3 on record which shows that the complainant has deposited the documents for release of the payment after maturity period with the OPs. The said receipt/ slip is also duly signed by the OPs.
6. For the reasons recorded above, we find that the complainant fully proves her case. As such, we allow the complaint of the complainant and direct the OPs to make payment of Rs.47664/- to the complainant along with interest @9% per annum from the date of filing of the complaint till realization. We further order the OPs to pay to the complainant a sum of Rs.5000/- as compensation on account of mental pain, agony and harassment and also to pay to the complainant a sum of Rs.1100/- as litigation expenses.
