1. Mithu Singh complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that on the assurance of the OPs, he purchased a policy number 978762 for the period from 16.02.2016 to 16.05.2017 in which the complainant was to deposit Rs.5000/- per month and after maturity the OPs had to pay Rs.90,000/-. The complainant deposited 11 installments of Rs.5000/- each . After maturity the complainant visited the OPs and submitted all required documents for release of the amount . The OPs issued acknowledgement/ receipt to the complainant but the OPs with malafide intention extended the date of maturity upto 27.01.2018 without consent of the complainant. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-
i) OPs be directed to make the payment of Rs.55000/- along with interest @18% per annum from the date of deposit till realization,
ii) OPs be directed to pay to the complainant a sum of Rs.22000/- as compensation on account of mental agony, harassment,
iii) OPs be directed to pay Rs.11000/- as litigation expenses.
2. Notices were issued to the OPs but despite service OPs did not appear and were proceeded exparte.
3. In exparte evidence, the complainant has tendered documents Ex.C-1 to Ex.C-4 and closed evidence.

From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant we find that the complainant purchased a policy number 978762 for the period from 16.02.2016 to 16.05.2017 in which the complainant was to deposit Rs.5000/- per month and the complainant deposited 11 installments of Rs.5000/- each which is evident from receipt issued by the OPs Ex.C-4. The complainant has produced on record copy of policy document Ex.C-2 which clearly shows that expiry date of agreement is 16 May 2017. It nowhere shows that maturity date of the policy is dated 27.01.2018. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte.

For the reasons recorded above, we allow the complaint of the complainant and direct the OPs to make payment of Rs.55000/- ( deposited amount) to the complainant along with interest @9% per annum from the date of maturity of the policy till realization. We further order the OPs to pay to the complainant a sum of Rs.5000/- as compensation on account of mental pain, agony and harassment and also to pay to the complainant a sum of Rs.1100/- as litigation expenses.
6. This order of ours shall be complied with within 60 days from the receipt of copy of the order. Copy of the order be supplied to the parties free of charge. File be consigned to records in due course. Announced
