By Smt. Padmini Sudheesh, President:<br /> <br /> Petitioner’s case is as follows:<br /> <br /> On 16.1.02 petitioner has deposited Rs.50,000/- in the first respondent firm. The interest promised was 30% and has mentioned in the receipt also. The due date is completed, but the amount is not returned till date. Hence this complaint.<br /> <br /> 2. All the respondents are declared as exparte. <br /> <br /> 3. The petition has filed by the petitioner himself. Later he has entrusted his mother to conduct the case through power of attorney and the exparte affidavit is filed by the mother. <br /> <br /> 4. To prove the case, an affidavit and one document are produced on the part of petitioner. The document is marked as Ext. P1. There is no evidence to the contrary. <br /> <br /> 5. In the result, the petition is allowed and the respondents are directed to return the amount of Rs.50,000/- (Rupees fifty thousand only) with interest at the rate of 15% per annum from 16.1.02 and 6% interest from today till realisation. The respondents are further directed to pay Rs.1000/- (Rupees one thousand only) towards costs.
