JUDGMENT /FINAL ORDER
Complainant above named filed this complaint against the aforesaid Opposite Party praying for direction for rendering proper service, refund of Rs. 21,000/-, compensation amounting to Rs. 50,000/- and litigation cost.
He alleged that he had booked a trip in the flight from Tejpur to Kolkata and paid Rs. 10,500/- in favour of the O.P. But flight was cancelled by the respondent airlines before four days and did not refund any amount. Thereafter Complainant purchased ticket by paying Rs. 21,000/- extra which is unfair trade practice. Hence, he filed this case.
O.P not yet appeared in this record inspite of service of notice.
Decisions with Reasons:-
Case was admitted on 21/02/2023. Thereafter, 30/03/2023 was fixed for evidence but on that date Complainant was absent without any steps. Even on the next date i.e. on 29/08/2023 Complainant was absent without any steps. Even on 11/12/2023 Complainant was absent without any steps.
Complainant was asked to file Show Cause by 01/03/2024 as to why necessary order shall not be passed against him vide order no. 07 dated 11/12/2023.
But on the next date i.e. on 01/03/2024 Complainant did not take any steps nor filed Show Cause as per order no. 07 dated 11/12/2023.
The conduct of the Complainant indicates that he is not willing to proceed with this case. In this situation we have no other alternative but to dismiss the case.
In the result, present case fails.

Ordered:-
That the present case be and the same vide no. CC/37/2023 is dismissed ex-parte against the Opposite Parties but without any order as to costs.
Let a copy of this order be supplied to both the parties free of cost as per CPR, 2005.
