2.      Rabindranath Roy, resident of village & Post Office: Barabelun, Police Station: Bhatar, District: Burdwan, PIN – 713 125.

3.      Surjya Kanta Roy, resident of Vill. & PO: Barabelun, PS: Bhatar, District: Burdwan, PIN – 713 125.

The ld. Counsel for the complainant is present. Today is fixed for admission hearing of its complaint. But the complainant by filing a petition has prayed for withdrawal of the complaint with a liberty to file the same before the appropriate forum/court.

It is seen by us that that the petition has been signed and stamped by the complainant, which has been identified by its ld. Advocate. As the complainant is interested to withdraw the complaint, hence we have no objection to resist the same. Accordingly prayer as made by the complainant is hereby allowed. In the interest of justice the complainant is at liberty to approach before the appropriate forum/court, if not barred otherwise in view of the landmark judgment passed by the Hon’ble Supreme Court in the case of Laxmi Engineering.

Going by the foregoing discussion hence, it is

that the Consumer Complaint being No. 13/2017 is hereby dismissed as withdrawal without being admitted.

Let a plain copy of this order be supplied to the complainant free of cost as per provisions of law.
