ORDER  

          The Misc. Application has been filed by the applicant I. Ali Yusuf for modification in the order dated 26-09-2023 passed by this Court in Appeal No. 1351/2023; Reliance Retail Limited & Another Vs I. Ali Yusuf with the following prayer :-

“Wherefore it is prayed that this Hon’ble Commission may graciously be please to modify order dated 26-09-2023 up to that extent that the cheque may be issued in the name of Respondent No.1, i.e. ‘Ishuk Ali’and the cheque issued on dated 03-10-2023 of amount Rs. 15,408/- in the name of ‘I. Ali Yusuf’ may be taken back and thereby may be directed to issue a fresh cheque in the name of the Applicant/Respondent No.1, ‘Ishuk Ali’ of the aforesaid amount, in the interest of justice.’’

          It has been stated by the applicant that the respondent no.1/applicant is known with the full name as I. Ali Yusuf and in the bank records and his personal documents, his name has been written as ‘Ishuk Ali’. The above said both names are one of the same person i.e. respondent no.1/applicant.

          In view of the aforesaid, the office is directed to take back the original cheque no. 210476 dated 03-10-2023 for Rs. 15,408/- which was issued in the name of I. Ali Yusuf and a fresh cheque be issued in the name of ‘Ishuk Ali’.

          With the above direction, the application is disposed of.
