                             Today is fixed admission hearing.

                             Ld. Adv. for the complainant is present. He files one document (Xerox). It is accepted and kept with record.

                             Case is taken up for admission hearing.

                             Perused the petition of complaint.

                             He alleged that he and his brother required some bricks for construction and he paid Rs.9,50,000/- to OP.

                             In this connection, OP executed one declaration on 06.08.2016. In the petition of complaint, complainant did not mention the date when cause of action arose. Perused the document dated 06.08.2016. In the said document it has mentioned that OP would pay the sum of Rs.9,50,000/- within Jaistho 1423. On calculation we find that same is 16.06.2016.

          Complainant did not file any petition for condonation of delay.

          From the aforesaid discussion it is clear before us that present case is barred by limitation.

          Hence,

                                                                             that the present case be and the same is dismissed without being admitted due to the reason as stated above.
