ORDER

By G. Yadunadhan, President: The case of the complainant is that on 17.1.2007, he booked a luxury bus from the opposite party for a journey on 11.2.2007 at 8.30 AM from nearby Purakkattiri Bus stop to Jaya Auditorium at Calicut for a marriage of the relative of the complainant. On 11.2.2007 at 8.20 AM the bus reached the above said starting place. At 8.30 AM the journey was started with the marriage party. While the bus reached in front of the Pooladikunnu bus stop, bus was stopped due to insufficiency of diesel. At that time complainant contacted the company over phone. Company assured that another bus would come over there within 20 minutes to continue the journey. Complainant and the marriage party waited there till 10 AM to 10.20 AM. Suddenly, complainant arranged small vehicles to continue the journey. Because of the negligent act of the opposite party, marriage party reached at Jaya Auditorium at 11.30 AM. Complainant paid Rs.1500/- as an advance and the balance amount on 11.2.2007 morning. Complainant suffered a lot due to the negligent act of the opposite party. Hence complainant seeking relief against opposite party for a compensation of Rs.40650/-. After duly serving notice, opposite party called absent and set exparte. Complainant filed affidavit and Ext. A1 to A3 were marked. From the affidavit and Ext. A1 to A3, complainant’s case is proved. In the result petition is allowed and the opposite party is directed to pay back the amount of Rs.3650/-, which is collected from the complainant and a compensation of Rs.5000/- to the complainant. Comply the order within one month. Pronounced in open Court this the 12th day of November 2008.
