Order No.03, Dated: 23.02.2015

The complainant files hazira along with a petition duly supported by affidavit praying to condone the delay and two copies of the same petition.  Let the same be kept with the record. 

Today is fixed for hearing on the point of admission.  Heard the representative of the complainants.  On scrutiny of the record it appears that the complaint has been filed by two persons namely Prasanta Kumar Mukherjee and Smt. Keka Mukherjee.  But the complaint petition has been signed by Prsanta Kumar Mukherjee only.  As per provision of law both the complainants have to put their signatures in the complaint petition.  Nothing is coming to show that complainant Smt. Keka Mukherjee has authorized the complainant Prasanta Kumar Mukherjee to file this complaint and to conduct the case on her behalf.

            So, we find that the complaint petition itself is defective and the same should not be admitted.  As the complaint petition is defective the consideration of the petition for condonation of delay does not arise.  Hence, it is

ORDERED

that the petition for condonation of delay filed this day is rejected and the complaint is not admitted. 

            The case is thus disposed of without any cost.  Let the plain copy of this order be supplied to the complainants free of cost.
