Learned counsel Sh. Deepak Ahluwalia for the appellant as well as learned counsel Sh. Chetan Jain for respondent No. 1 alongwith respondent No. 1 has appeared.
As per previous order sheet, both the parties have submitted a compromise (paper No. 78) before the Commission which was duly endorsed, signed and accepted by both the parties. The compromise has already been accepted and verified by this Commission.
Today learned counsel for the appellant has stated that as per terms of compromise, an amount of Rs. 3 Lakhs is to be paid to the respondent No. 1 – Sh. Aakil, which shall be payable after the final order in this appeal.
Learned counsel for the appellant has stated that after the final order, the insurance company shall pay the above-said amount within 30 days.
As the compromise has already been accepted, therefore, the appeal is decided in terms of compromise and the above compromise (paper No. 78) shall form part of the decree. No order as to costs of the appeal.
It is hereby ordered that the appellant – insurance company shall pay Rs. 3 Lakhs (Rs. Three Lakhs only) to respondent No. 1 – Sh. Aakil within a period of one month from today, in default the appellant – insurance company shall pay simple interest @ 12% per annum from today till its actual realization.
Statutory amount, if any, deposited by the appellant be returned to the appellant, subject to the condition of submitting the receipt of payment of Rs. 3 Lakhs to the respondent No. 1.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith compromise and original record be sent to the District Commission concerned for perusal and necessary information.
