No step is taken by the parties. Record shows that the Complainant was directed to take fresh steps several times but the Complainant has not complied with the order of this District Commission. The point to be noted is that the Complainant has not been taking steps in this case for long period. The case of the Complainant in short is that the Complainant had paid Rs. 91,000/- to the OPs for the purchase of brick to the extent of 14,000/- @ Rs. 6,500/- per monsant and the OPs used to run their brick field in the name of Sheeb Real Projects Ltd. at Saskan Road, Raghunathganj. Those brick were required for the construction of the house of the Complainant but despite payment of Rs. 91,000/- by the Complainant, the OPs failed to supply brick. For that reason the construction had been delayed. Aprat from so many intimation to deliver the brick, the OP turned a deaf ear to his intimations as well as requests. After a lapse of time, the Complainant came to know that the OPs have already wound up his business after taking money from many customers. Under these circumstances the Complainant prayed for directing the OPs for making good the loss sustained by the Complainant to the extent of Rs. 91,000/- and Rs. 4,09,000/- for mental pain and agony totaling Rs. 5,00,000/- from the OPs. We peruse the materials on record. We find that the Complainant took no steps on 09.12.21, 28.02.22, 11.05.22, 04.08.22, 28.11.22, 06.03.23, and today i.e. 07.06.23. Moreover, considering the facts and circumstances of the case we are of the view that the instant case has no merit as the Complainant is not at all interested in the case. In view of the matters discussed above we are of the view that the instant case is liable to be dismissed on merit. In the result, the instant case fails. Fees paid are correct. Hence, it is Ordered that the instant case bearing No. CC/124/2020 be and the same is dismissed on merit without cost against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
