 Seen the order dated 5.10.2023 which is as follows:

“Called out. Ld. counsel for the appellant is on leave. None for the respondent’s side.

This is an old case of 2013, so parties are directed to note that in such old cases, no adjournment or leave shall be taken into account.   

 Put up on 19.10.2023 for hearing within first 20 cases.”

This is old case of 2013 and it has clearly been mentioned in the last order sheet that no adjournment or leave shall be taken into account. In spite of it in such an old case parties are not present either on leave or on adjournment. Hence, it will not be considered. The appeal is liable to be dismissed.

The appeal is dismissed.
