Learned counsel appearing for the appellants, under instructions, states that the appellant hospital is willing to pay an ex-gratia amount of Rs.50,000/- to the complainant/respondent if the complainant is prepared to withdraw the allegations of medical negligence made by her in her complaint. He states that the question of costs is left to the discretion of the Commission. The said offer is acceptable to the complainant/respondent. The statements of parties in regard to the terms of the settlement have been recorded separately which will form part of this order. ..2.. In view of the settlement reached between the parties, the appeal is allowed and the impugned order is hereby set aside. The complaint will also deem to have been dismissed. The Registry is directed to disburse the deposited amount of Rs.35,000/- along with accrued interest thereon to the complainant and the appellant hospital will remit the balance amount of R/s.15,000/- and costs of Rs.10,000/- to the complainant/respondent directly by means of demand draft within a period of four weeks fom today. The appeal stands disposed of as settled.
