1. At the time of admission of this complaint on 06.06.2022, this Commission had expressed doubts as to the maintainability of the complaint. Hence admission was granted on condition that the question of maintainability will be heard.
2. In the interest of justice, so as to weed out any possibility of rushing into a conclusion, notices were issued to opposite parties and the opposite parties filed version.
3. Complainant is aggrieved by the alleged non-registration of his wedding by the officials of the opposite party Municipality. On going through the pleadings of the parties we find that the grievance of the complainant is with regard to a statutory function that is carried out by the opposite parties. Eventhough it is a process that is carried out by remittance of a prescribed fees, that fees cannot be equated to be a consideration as contemplated under the Act. Further the complainant is not a consumer as contemplated under the Act, vis-à-vis the opposite parties.
4. Hence the complaint is dismissed.
5. In the facts and circumstances of the case, the parties are directed to suffer their respective costs.
