ORDER

Sri. S. Viswanadhan has filed the complaint before this Forum alleging deficiency in service on the part of the opposite party. The case of the complainant is that he is engaged in the business of textiles in his residence. The opposite party contacted the complainant and taken 90% the textile items from his possession and left without giving any payment. Complainant has requested the opposite party to give the payment of the textile items. But the opposite party refused to pay the price of the items which comes to Rs.51,600/-. Since the complainant has not obtained any relief in payment from the opposite party, he has filed the complaint alleging deficiency in service on the part of the opposite party. 2. Notice was issued to the opposite party. She entered appearance and filed objection. In the objection, it is stated that the complainant is not a consumer and the matter will not come within the purview of the “Consumer Dispute.” It is further stated that the opposite party has paid back the entire amount of the textile item which was purchased from the complainant and that no amount still pending by way of balance purchase price. 3. On perusal of the complaint, objection and after a detailed hearing, we are of the view that the complainant is not a consumer and the matter will not come within the purview of the consumer dispute. Considering the above matters, the complaint is to be dismissed. In the result, the complaint is dismissed. No order as to costs. Pronounced in open Forum on this the 29th day of May, 2008. Sd/- SRI.
