None appeared for Respondent No. 2 since many dates and in such circumstances Respondent No. 2 is proceeded ex-parte.

          Heard learned counsel for the parties.

          During course of arguments learned counsel for the parties arrived at settlement and submitted that petitioner will be making payment of Rs.40,000/- to Respondent No. 1 within a period of 30 days from today in full and final settlement of claim, which is accepted by learned counsel for Respondent No. 1.  In such circumstances, revision petition is partly allowed and impugned order dated 26.02.2013 passed by learned State Commission in First Appeal No. 1842 of 2009 – Ajit Raj Vs. Smt. Maya Devi Twinkel Star Public School & Ors. and order of District Forum dated 16-10-2009 passed in Consumer Complaint No. 674 of 2008 - Ajit Raj Vs. Smt. Maya Devi Twinkel Star Public School & Ors., is modified and opposite party/petitioner is directed to make payment of Rs.40,000/- as full and final settlement to the complainant/respondent no. 1 within 30 days from today.  Revision petition stands disposed of in terms of settlement arrived at between the parties, which shall form part of this order sheet.
