SBI Life Insurance Co. Ltd. filed a consumer case on 30 Jan 2018 against Ajay Wadhwa in the StateCommission Consumer Court. The case no is FA/308/2010 and the judgment uploaded on 05 Mar 2018.
The appellant has filed this appeal against order dated 01.09.2010 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short ‘the Forum’) in Criminal Complaint No.50 of 2010, vide which, for non compliance to an order passed on 06.05.2009, the Manager of the appellant was sentenced to undergo imprisionment for two years and to pay a fine of Rs.10,000/-. In default of payment of fine, he was further directed to undergo imprisonment for a period of six months.
As per facts on record, against order dated 06.05.2009, the appellant came in appeal before this Commission, which was dismissed. Thereafter, the appellant filed Revision Petition bearing no.4487 of 2009 before the Hon'ble National Consumer Disputes Redressal Commission, New Delhi. Due to pendency of the revision petition, this appeal was adjourned sine-die. The said revision petition was disposed of on 09.11.2016. Thereafter, on orders passed by this Commission, this appeal was taken up for hearing.
Sh.Prabh Dyal Wadhwa, respondent No.2 has put in appearance and stated that the judgment passed originally on 06.05.2009 by the Forum stands satisfied. If that is so, we feel that there is no justification to impose imprisonment upon Manager of the appellant Bank, which was done vide order dated 01.09.2010 passed by the Forum.
In view of above, this appeal stands disposed of having been fully satisfied and the aforesaid order is set aside.
