This is a bunch of 21 transfer applications filed by the same applicant that is Shri Ganesha Builder and Developers though its proprietor Mr. Ajay Vasantrao Ninave pending before this Commission since 2012. The perusal of the said applications reflects that is filed for seeking transfer of complaint pending before the Addl. District Consumer Forum, Nagpur to any other District Consumer Forum, within the State of Maharashtra. As none for the applicant appeared in this matter in spite of being informed by this Commission, report was called from the Additional District Consumer Forum, Nagpur seeking report about the progress of the original complaints. The Addl. District Consumer Forum, Nagpur by its report dated 26/08/2015 informed this Commission that the complaints sought to be transferred in all these transfer applications bearing Nos. TA 1,2,4,6,7,8,9,10,13,16,19 and 20 of 2012 have been already decided on 3/4/2012 by the District Consumer Forum and the Consumer complaints sought to be transferred by transfer applications bearing Nos. TA 3,5,11,12,14,15,17,18 and 21 of 2012 have been already decided by the District Consumer Forum on 29/05/2012. In view of the report of the Additional District Consumer Forum, Nagpur, these transfer applications need to be dismissed being infructous. Therefore I dismiss the transfer applications bearing Nos. 1,2,4,6,7,8,9,10,13,16,19,20 of 2012 and TA Nos. 3,5,11,12,14,15,17,18,21 of 2012 as infructous. |
