ORDER

 

Fresh complaint heard on grounds of territorial jurisdiction since the complainant is residing at Nand nagri which comes under North-East and OPs address is at New Delhi-110086 and Noida, though complainant is relying on MCA data. However, all correspondence by way of booking of residential apartments, payment receipts, acknowledgements have been issued by OP from its Noida office and the registered office is also mentioned on the letter head as Mange Ram Park, New Delhi – 110086 and Corporate office  at Noida. The complaint is therefore not maintainable on grounds of territorial jurisdiction and is dismissed under section 34 (2) of CPA 2019 with liberty to the complainant to file it before the appropriate District Commission having territorial jurisdiction to entertain the same. Therefore, the case is dismissed as not maintainable. File be consigned to record room.
