ORDER

SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  The opposite party entered appearance and filed written version denying the allegation raised by the complainant.  Since 12/02/2020 this case is adjourned for filing affidavit of the complainant.  On 19/04/2022, when the case came up for consideration it is noticed that the complainant is continuously absent and hence this Commission issued  a notice to the complainant to appear before this Commission today, to further proceed with this complaint.  When the case came up for consideration              today, the notice issued to the complainant is seen returned with endorsement intimation served and ‘unclaimed’.  The complainant has not filed affidavit inspite of giving sufficiency opportunities.  In the above circumstances we find that the complainant is not interested to further proceed with this complaint. 

In the result the complaint is dismissed for default.  There will be no order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
