Instant hearing arose out of a petition dt. 04/10/2012 filed by the o.p. challanging the maintainability of the case.
We have gone through the petition dt. 04/10/2012 alongwith the decesion filed by the complainant together with entire materials on record and we find keeping on eye to the decision of the Hon’ble Supreme Court passed in General Manager, Telecom VS. M. Krishnan & another (2009) & Sec 481 and judgement passed in RP no. 17032 of 2010 of the Hon’ble National Commission, this Forum is not in a position to entertain the matter.
In view of the above, the petition dt. 04/10/2012 filed by the o.p. is allowed on contest and the the instant case is not maintainable.
Thus the complainant case stands disposed of accordingly.
