COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 AS AMENDED UPTO DATE

Present:-      Sh. Deepan Sharma, Authorised Representative of the Complainant.

                   Sh. Daksh Prem Azad, Advocate, Counsel for OPs No. 1 to 3.

 

                   Today the case is fixed for filing evidence by the OPs. At this stage, Ld. Counsel, on the instructions of OPs No. 1 to 3, by making a separate statement, states that in accordance with the settlement made between the parties, the OPs are ready to give a Demand Draft amounting to Rs. 52,000/- to the Complainant, within 55 days from today, considering the old age of the Complainant along with delayed payment in question, harassment and litigation charges, failing which interest at the rate of 9% per annum shall be paid to the Complainant on Rs. 52,000/-.

                   On the other hand, Shri Deepan Sharma, Authorised Representative of Complainant, by making a separate statement, states that he has gone through the statement made by the Ld. Counsel for the OPs No. 1 to 3 and agrees with the same and thus, he withdraws the present complaint on behalf of Complainant.

                    Heard. In view of the statements made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective statements. In case, the OPs No. 1 to 3 fails to comply with the statement made by the Ld. Counsel on their behalf, in that event, the Complainant shall be entitled to initiate proceedings under section 71/72 of the CP Act, 2019.            

                   A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
