ORDER
No step from the side of the Complainant.
Learned Advocate Mr. P. Chakraborty is present for the O.P. No.1.
We heard Mr. Chakraborty in respect of maintainability of proceeding.
Mr. Chakraborty submitted that O.P. No.1 prefered an appeal against the order dated 23/05/2021 and the Hon'ble State Commission set aside the order and made an observation that the complaint petition filed by the respondent/Complainant has suppressed a material fact and gave a direction to this Commission to dispose of the complaint after providing proper opportunity to the parties.
Complainant is absent for consequative dates, we have seen the order of the Hon'ble State Commission passed in A/22/2021 dated 05/07/2021.
Learned Advocate Mr. Chakraborty made submission before the Hon'ble State Commission that the cost of the ticket amounting to Rs.17,781/- has already been paid to the Complainant.
In support of his aforesaid submission he has submitted documents and the Hon'ble State Commission accepted the submission of Mr. Chakraborty.
Today Mr. Chakraborty submitted that complaint is not maintainable due to suppression of facts.
We have considered the submission of Mr. Chakraborty and we found that the Complainant has suppressed material facts and for this reason this complaint is not maintainable.
Accordingly, complaint is dismissed and no costs. The case is disposed of.
